എഫ്ഐആറിന് പകരം പ്രാഥമിക അന്വേഷണം
2026 സെപ്റ്റംബർ ഏഴിന് എൻഫോഴ്സ്മെന്റ് ഡയറക്ടറേറ്റ് സംസ്ഥാന പൊലീസ് മേധാവിക്ക് കത്തയച്ചു. സിഎംആർഎൽ–എക്സാലോജിക് ഇടപാടുകളിൽ അഴിമതി നിരോധന നിയമപ്രകാരം കേസ് രജിസ്റ്റർ ചെയ്യണമെന്നായിരുന്നു ആവശ്യം. എന്നാൽ സർക്കാർ നേരിട്ട് എഫ്ഐആർ രജിസ്റ്റർ ചെയ്യുന്നതിനു പകരം പ്രാഥമിക അന്വേഷണം നടത്താൻ പ്രത്യേക അന്വേഷണ സംഘത്തെ നിയോഗിച്ചു. ഈ നടപടിയാണ് കെ.എം. ഷാജഹാന്റെ ഹർജിയിലൂടെ ഹൈക്കോടതിയിലെത്തിയത്.
സെപ്റ്റംബർ ഏഴ്: ഇഡിയുടെ കത്ത്
ഇഡി കൈമാറിയ വിവരങ്ങൾ കള്ളപ്പണം വെളുപ്പിക്കൽ അന്വേഷണത്തിൽനിന്ന് ലഭിച്ചതാണെന്നും അഴിമതി നിരോധന നിയമപ്രകാരമുള്ള കുറ്റങ്ങൾ പരിശോധിക്കണമെന്നും ഏജൻസി ആവശ്യപ്പെട്ടു. കത്തിൽ പരാമർശിച്ച വിവരങ്ങളുടെ അടിസ്ഥാനത്തിൽ പൊലീസ് എന്ത് നടപടിയെടുക്കണം എന്നതായിരുന്നു തുടർന്നുള്ള നിയമപ്രശ്നം.
പ്രത്യേക അന്വേഷണ സംഘം രൂപീകരിച്ചു
സംസ്ഥാന സർക്കാർ പ്രാഥമിക പരിശോധന നടത്താൻ തീരുമാനിച്ചതിനു പിന്നാലെ ക്രൈംബ്രാഞ്ചിന്റെ ഒൻപത് അംഗ പ്രത്യേക അന്വേഷണ സംഘത്തെ നിയോഗിച്ചു. ലഭിച്ച വിവരങ്ങൾ പരിശോധിക്കാൻ മുപ്പത് ദിവസത്തെ സമയവും അനുവദിച്ചു. സർക്കാർ സ്വീകരിച്ച നടപടിക്രമം നിയമപരമാണോ എന്നതായിരുന്നു ഹർജിക്കാരൻ ഉന്നയിച്ച പ്രധാന ചോദ്യം. പ്രത്യേക സംഘത്തെ നിയോഗിച്ച രീതിയും അതിന്റെ അധികാരവും ഹർജിയിൽ ചോദ്യം ചെയ്തു.
കോടതിയിൽ ഉയർന്ന നിയമപ്രശ്നം
ഇഡി വിവരങ്ങൾ കൈമാറിയാൽ സംസ്ഥാന പൊലീസ് ഉടൻ എഫ്ഐആർ രജിസ്റ്റർ ചെയ്യേണ്ടതുണ്ടോ, അതോ പ്രാഥമിക അന്വേഷണം നടത്താൻ കഴിയുമോ എന്നതായിരുന്നു കോടതിയുടെ പരിഗണനയിലെ കേന്ദ്രവിഷയം. ഇഡി നൽകിയ വിവരങ്ങളിൽ കേസെടുക്കാൻ മതിയായ വസ്തുതകളുണ്ടെങ്കിൽ വീണ്ടും പ്രാഥമിക അന്വേഷണം ആവശ്യമില്ലെന്നായിരുന്നു ഹർജിക്കാരന്റെയും ഇഡിയുടെയും വാദം.
മറുവശത്ത്, ലഭിച്ച വിവരങ്ങൾ പരിശോധിച്ചശേഷം തുടർനടപടി തീരുമാനിക്കാമെന്നായിരുന്നു സർക്കാരിന്റെ നിലപാട്. നിയമോപദേശം തേടിയ ശേഷമാണ് പ്രാഥമിക അന്വേഷണത്തിന് ഉത്തരവിട്ടതെന്നും സർക്കാർ കോടതിയിൽ വാദിച്ചു. ഹർജി നിലനിൽക്കുമോ എന്ന കാര്യത്തിലും സർക്കാർ എതിർപ്പ് ഉന്നയിച്ചു.
വിധിക്കായി കാത്തിരുന്ന ദിവസങ്ങൾ
വാദങ്ങൾ പൂർത്തിയായതോടെ ഹൈക്കോടതി വിധി പറയാൻ മാറ്റിവെച്ചു. ഇഡിയുടെ കത്തിൽ പരാമർശിച്ച വിവരങ്ങളുടെ നിയമപ്രാധാന്യവും സംസ്ഥാന പൊലീസിന്റെ അധികാരപരിധിയും ചർച്ചയുടെ കേന്ദ്രമായി. കേസ് എങ്ങനെ അന്വേഷിക്കണം എന്ന തർക്കം, ഒടുവിൽ അന്വേഷണം തുടങ്ങാൻ ഏത് നടപടിക്രമമാണ് നിയമപരമെന്ന ചോദ്യമായി മാറി.
